本课程将以美国宪法为主，但也会涉及其他国家宪法。课程内容每年会有所更新，但总体分为两部分：第一部分关注权力（power），将采取纵向视角，按照历史顺序讨论美国从独立、建国、制宪、内战与重建、新政、民权运动、保守主义复兴直到当代的宪法发展。第二部分关注权利（right），将结合相关领域判例，围绕自由、隐私和平等等议题展开讨论。 |
| 英文简介 |
This course focuses on the history, practice and theory of U.S. constitutional law, but will discuss other countries’ constitutions as well. The course divides into two major parts. First, it will examine the development of U.S. constitutional law over the course of the Founding, Civil War and Reconstruction, New Deal, Civil Rights Movement, Reagan Revolution to nowadays. Second, by studying the Supreme Court decisions and relevant legal scholarship, it will also discuss issues involving free speech, privacy as well as equal protection of law. |
