伴随着互联网和智能手机的发展，图像越来越多地融入我们生活与工作，已经有越来越多的与图像相关的问题需要涉及到法律问题，一些图像相关的争议已经到法院诉讼。在法律上急需做出司法解释。但是司法机关面对这些问题，也是全新的问题，过去也没有遇到过，没有经验和案例可循。法院一线法官和法学院理论研究工作者都需要抓紧研究。在编写讲义的过程中，我收集了一些中外图像相关的司法案例，并进行一定程度的分析和研究，特别是从图像与文字表达的比较中，找出图像的特点，并结合图像的特点来研究。例如，在图像表达的特点中，图像表达的多维化，接受认知的个性化，图像的跨文化特点等，都与文字表达有明显不同。过去我们的法律主要集中于对法律文本和行为的研究，很少涉及图像的研究，或者认为图像是附属于文本的“附件”。现在看来，图像正在脱离文字，成为独立存在的传播形式，从内容到形式都是独立于文字的。因此对图像的法律研究便成为一个新课题，研究的一个新领域，司法解释中的一个新分支。有可能出现一个与文本研究非常不同的独立研究方向。同时，还需要在传统的图像理论研究方面，结合法律研究方法，摸索出为法律解释图像争议问题的具体工作做打好基础，做好理论准备。 |

With the development of the Internet and smart phones, images are more and more integrated into our life and work. There are more and more image related issues that need to involve legal issues. Some image related disputes have been brought to court. Judicial interpretation is urgently needed in law. But facing these problems, the judiciary is also a brand-new problem, which has not been encountered in the past, and there is no experience and case to follow. The front-line judges of the court and the theoretical researchers of the law school need to pay close attention to the research. In the process of writing the handout, I collected some judicial cases related to Chinese and foreign images, and conducted some analysis and research, especially from the comparison of image and text expression, to find out the characteristics of the image, and combine the characteristics of the image to study. For example, in the characteristics of image expression, the multi-dimensional image expression, the individuation of cognitive acceptance, the cross-cultural characteristics of image are obviously different from the text expression. In the past, our law mainly focused on the study of legal texts and acts, rarely involving the study of images, or considering images as "attachments" attached to texts. Now it seems that image is breaking away from text and becoming an independent form of communication, which is independent of text from content to form. Therefore, the legal study of image has become a new topic, a new field of study, a new branch of judicial interpretation. There may be an independent research direction which is very different from the text research. At the same time, in the traditional image theory research, combined with the legal research methods, we need to find out the specific work to lay a good foundation for the legal interpretation of image disputes, and make theoretical preparations. |

通过授课，让法学院学生从图像的角度来思考问题。因为过去都是从文本的角度来思考问题的，例如，我们看合同文本，根据文本上的文字，来分析合同双方的权利义务，确定责任与赔偿，或和解。现在我们面临的是图像争议，没有文字，如何法院确定争议双方的权利义务呢？如何确定责任与赔偿呢，或如何达成和解呢？这些都需要在法律上对图像做出司法解释。课程的目的就是训练学生根据对图像的研究，做出适当的司法解释。

第四，儿童启蒙图像与道德教育；
第五，社会图像与习惯法；
第六，表情包传播与司法解释；

第十一，漫画图像讽刺界限与法律；
第十二，自媒体图像的法律问题；
第十三，图像的深度伪造与法律；

课堂讲授为主，讨论为辅
